It's an odd reference to make in reply to a comment about CER being oversold. All are well aware of the ongoing legal issue with Slater & Gordon et al.
Having been a party to a Federal Court Case once upon a time, I can tell you that seldom, very seldom do cases like this go all the ay to a judgement.
When they do then the losing party seeks leave to appeal to the full bench of the Federal Court to have the matter heard again.
And if the full bench deem it of National significance the losing party at this point may be granted leave to appeal to the Federal Court (an even rarer occurance).
Whatever the outcome, this will either settle out of court through Mediation (funded largely by insurance) which the judge has actually ordered, or the case will be abandoned (unlikely).
Nonetheless, if the wheels of justice turn and turn and turn in respect of this court case, the Credit Crisis, Recession and Bear Market will be a distant memory when this matter is concluded.
