Just stumbled onto this thread,,,,,,, "Warning Will Robinson",, Discretionary Trusts that are promoted for succession planning etc etc have a massive failing. The recipients can take the trustee to court at anytime and claim full entitlement and or take control of the trust for themselves. They only have to claim that the trustees are not operating the trust properly and the bonus is that the legal fees to defend yourself is payable by you, not the trust. However the claimants costs are also payable by you as the trustee in question. It is up to you to defend yourself as far back as any of the claimants wont to go. Ie worked after school to help with household budget.
