Hi seanl, about 12 months ago Derek from California posted on HC an account of a discussion he had with Carl (and Peter as well, I think) in which they told him that the company does not believe that it has grounds to extend the Graham patents beyond 2018. I am sure that they would not have said this without advice from their patent lawyers.

I think we should expect that this is the case and see it as a bonus if a patent extension is applied for and granted.
