Fair enough in an environment of full disclosure. This all came as a surprise to the market, which is why some are upset. It was unreasonable for the bank to make their intentions known at the last minute. Legal, perhaps - but arguably underhanded. Of course management has a lot to answer for, for misrepresenting the financial security of the company.
It seems a common thread in publicly listed companies, to keep holders poorly informed. In my stock market dreams businesses have open books with continuous balance sheet disclosure, you just check it out online :).
