i'm enthusiastic about ozl but i received an email from slater & gordon regarding the class action and in part it says - ..............."1. We confirm that mediation of the class action occurred on 3 March 2011. The mediation was conducted by former Federal Court judge, Mr Roger Gyles AO QC as mediator.
2. The main participants at the mediation were:
a)
Three representatives of OZ Minerals including the Chief Executive Officer and General Legal Counsel;
b)
Freehills, lawyers for OZ Minerals;
c)
Slater & Gordon and litigation funder Litigation Lending Services;
d) Anthony Scott and Nicola Taws, our named representative applicants, who were available by telephone;
d)
Maurice Blackburn, solicitors for the Applicant in the Hobbs Anderson class action against OZ Minerals and IMF, litigation funder; and
e) A number of representatives of institutional investors.
3. The mediation commenced at 10:30am and concluded at 5:30pm. The parties were given a number of opportunities, firstly during a joint session then in a number of private sessions between the OZ Minerals? representatives and the applicants? representatives, to agitate the merits of their respective cases and their position with respect to any settlement out of court.
4. A number of offers were made by OZ Minerals on the day, however, in our view the amounts offered were not a reasonable compromise of the claims of group members.".........
