It was pointed out to you many times during those five years that the NEL ESS clearly stated PASS was to be considered as fill . It's all in the documents . It was also made very clear that the EPA considers reuse preferable to disposal . Again you blame a government for a failure of NAG management .
Even if PASS wasn't considered as fill , NAG never had a chance . A cash strapped company with no equipment or experience 145 k's from the works !
