Well this is going to be a little interesting.
See this patent that was granted. AU2022306695A1 - "process for producing high purity aluminium materials" - Google Patents
So I am by no expert in this legal and IP field but it seems to be a all encompassing patent. It is also very clear that A4N was doing their Al SX thing long before the patent was filed. So either IMHO CMX enforce it and tell A4N to stop (which clearly they can contest) or CMX does not enforce it and their patent is invalid.
