Isn't the issue that Sunburnt suggested "The directors could find themselves in serious trouble with ASIC if they continue to trade when the company isn't a going concern."
It's a big call, to suggest the company isn't a going concern - true, the directors of NXS would be in big trouble if they continue to trade whilst bust, but that is true of every ASX company!
