Any director may find themselves in serious trouble if they trade whilst insolvent. This is simply a legal fact. Not sure anyone is suggesting this is the case with NXS.
Certainly given the non-current nature of debt, net asset position and equity facility, it would be a big call (and wrong, IMHO) to suggest that NXS is currently insolvent.
Valuation of course is a whole different issue......
