Nothing is stopping them. But it's not exactly bad, once it's in motion it may (or may not) show it's a poor model of legalisation. If states can see a case study of different models it may infact show that there is more revenue to be made in having a competitive legislation rather than a monopoly driven legislation.
It will be interesting to see the price competitiveness of a NY bookie compared to NJ bookies which will most likely provide better betting odds. Just because it's legalised doesn't mean that it's going to achieve any revenue model that NY hopes for.
