So to your legal mind, the strong possibility that the accused did not have any opportunity on that day to commit the alleged sex acts, as the unchallenged (in court) witnesses statements asserted, is merely a TECHNICALITY and therefore should be dismissed as irrelevant by the High Court.
I do wonder what would rank as a major flaw to a legal argument in your brilliant legal mind?
