The court case is on 8 October. As I understand it the two parties entered into a Deed of Amendment in August 2012 addressing what would happen if BRL failed to pay the performance payments when due. In short it provided that a failure to make a performance payment was 'not an actual breach of or default under the agreement for as long as the relevant royalty payments continued to be made under the royalty deed'.
