no I'm not saying that at all. I'm saying that 100% no arguments were made in front of the court or a judge. And that the court or judge made no comment or told anyone anything:
the govts lawyers and our lawyers sorted it out between them and at the end of the day they agreed to adjourn until Feb and vacate the dates previously set: that's the facts.
your narrative was that the judge had input and told them they couldn't have the case dismissed etc and that is simply not possible. They never appeared in front of the courts to make arguements and the judge never issued any rulings.
a federal court judge simply rubber stamped the consent order prepared by Clayton utz and our lawyers to make it official.
