They will get litigation funding. What they are asking for at this stage is funding to cover the costs of obtaining the information they need to solidify the case against KPMG for maximum damages - this will attract the litigation funders to support the class action. Funders want to see a solid brief with a good chance of a successful, high payout case.
Litigation funding is the only way to go as you will not make yourself personally liable for any negative outcome, no matter how unlikely.
If funding is obtained, you will get a refund of this initial payment.
After reading their latest email, it sounds like they feel confident.
However, I don't believe Bart will co-operate with handing anything over. One of the reasons he was probably brought in was to keep the protection of his mates ongoing.
