The question is can they do clinical trials without the right patent? they can currently use the drug in a preclinical setting as it isn't being used on humans (I think this is what Dr T has stated)
And furthermore, even if they could without the patent, why would they then waste resources trialing a drug that they can't actually sell? They're spending tens of millions to hit a dead end due to patents?
