Would texting on a phone, and having a collision, be an ACCIDENT, "often with lack of intention or necessity" or a deliberate act of stupidity knowing full well that you WILL take your eyes off the road?
Spilling the milk or stepping on the cats' tail could be classed as an accident. but running up the back of another car because your not pay attention, for whatever reason, is NOT AN ACCIDENT........
Even the front wheel coming adrift, causing the vehicle to run into something, is NOT AN ACCIDENT, but carelessness and or incompetence on behalf of whoever last fitted the wheel.
