If court proceedings begin but at some point a negotiation is done then that will be be a reflection of Heathgates perception of of the case and how the judge may rule on it.

I think the cut off for negotiation as far as the poll should be is up until the trial begins.

For mine, an offer to be tabled very late in trial (why negotiate before you have a sense of how the trial will unfold) and because your offer will be relatively low ball anyway it won't really matter at what point its tabled. I imagine a settlement could occur at any point up until the judgement is arrived at??
