Fleetfoot was suggesting that individuals may not be treated the same as those in pooled nominee accounts.

In the case you gave, as an individual Harry will get the prorata average of say 45%.

As pooled investors Harry might get more than 45% if the nominee claims a maximum for all pooled investors and then gives Tom and Dick the cash they requested and Harry the TLW shares which would have gone to Tom and Dick.
