Pretty dissapointing, Personally I think it would depend on the contract with the rail operator who would hold any liabilities, Id say that if OZL had indemnity they would have already boasted it, Instinctively it sounds like there has been a really bad call made here, Let's face it if you were transporting millions of dollars worth of concentrate that you knew contained uranium would you put it on a carriage under a tarp? How much does that really save you comparatively to the risk?
To prove negligence it has to be reasonably foreseeable that the damage could occur, Since its unconventional to use a bloody tarp on a container its probably pretty likely a judge would claim negligence IMO,
96kg of uranium is a big worry for me, With all that cash there is no excuse to avoid get someone who really knows their stuff to clean that mess up ASAP.
