Thanks for a sensible post! I have few questions though that dawned on me when I read your post.
Lets assume SMM win (i.e. their LOI was cancelled wrongfully) and that the landowners will never allow SMM on their land to mine it (which most of us, including the guys from RCR, believe is the case).
- What does that mean for the LOI that was awarded to AVQ?
- How can SMM then "legally" have their LOI cancelled, or how should that have been done?
- Can a LOI actually be cancelled?
- Does cancelling a LOI (if possible) lead to a re-tender to all parties?
- How long (i.e. years) will it take until AVQ will finally be permitted to mine the land if we have to go through the motion of cancellation, re-award, etc?
I fully agree that AVQ haven't done anything wrong and that they (we actually) are unfortunate to be stuck in this situation, which is really between SMM and the SI government. But what does that mean for us if the judge rules in SMM's favour?
I am not trying to be smug here! I really would like to have some sensible answers to that? Anyone?
