SMM will try and argue that the Gov defaulted on its obligation wrt the tender agreement in obtaining the necessary condition precedents
I'm guessing, a clause of the tender contract would say subject to the Gov receiving necessary approvals, including consent from land owners - given that the Gov knows ultimately the land owners have a right of refusal
