Re-Tender is unlikely but not impossible because this shows judge brown's inability to be as a judge to come to a final ruling in favor of either of the parties.

Re-tender would indicate that judge lost the plot with the complexity and details and is unable to determine who is right for the claim. If it comes down to re-tender then it should have been the case 2 years ago when the case initially entered the court room.

Judge brown may have to update his linkedlin profile if he hands down re-tendering as a verdict as he will no longer have a job as a judge lol

The analogy would be asking horses to run the race again because the judges could not make out who came to no.1 spot due to poor eyesight
