Companies all over the world have been doing business and signing contracts with Chinese businesses for decades. And the onus of ensuring contracts are "Valid" and "Enforceable" are NOT the responsibility of Mgt - its their Lawyers!!!

If you didn't know already, there are plenty of International Law firms that have offices in China, as well as having offices in many other countries around the world.

And they are the ones who are appointed by companies like BHP, WPL, RIO and PLS to draw up contracts in both English and Chinese (if needed).

And they are the ones who are responsible for ensuring all the terms and conditions are included. Its their job to know the contract laws of the country; not the Mgt of the company who secured the deal.

Bloke made the SAME point that you made ........ you actually reinforced his thoughts ..... but you called him a fool. Nobody on HC is privy to sighting the legals .... so nobody actually knows.

Not tryin to inflame here .... just add balance.
