It is my understanding that Axiom has requested that SMM can't appeal this ruling in case Axiom wins. Of course, I guess that applies to Axiom as well if Axiom looses. (Have a look at the court proceeding updates from the last couple of weeks.)
In either case; I guess it would be difficult to appeal. This case has been dragged out for so long and is so high profile (the outcome setting an example for any future court cases on these kind of matters); SMM would need to have really strong poinst to be given another shot. I really doubt this is going to happen.
Also, todays announcement that Sumitomo’s Application to amend their claim was rejected sets the tone.
