I think everyone will agree it's a poor situation, given what the timeline was supposed to be.

The attraction using IE for disputes is not insignificant. To go the legal route can and often does result in years, rather than months. not to mention a great deal of money donated to our legal profession. However I do have sympathy for the view that the situation has been unacceptable on a couple of fronts, to initially say a June decision was likely means you got it wrong, for a decision not to be made 4 months later means you got it very wrong.

The defence is always how could we have known, well that is a response, but that’s all it is, it is not a proper answer given the responsibilities here, but I suggest that commentary is for later.

My take is that nothing has been released regarding the determination, they just don't work like that, the attraction is the binding decision, here it is get on with it sort of deal. My feel is we are close, I have recently said weeks, I would plump for something well before the AGM, which if so is between now and a couple to three weeks away.

This is pure speculation on my part. Also speculation on my part is that the bulk of the dispute will settle in COB’s favour as I read the TJV Agreement, but maybe not every single point, still enough to see the market view COB in a different and more favourable light.

I have been asked by a few to say what I think after such a long delay, hence this is what I think.

Time will tell.
