THE COURT ORDERS THAT:

1. Schedule 1 of the Subpoena dated 30 January 2014 to the Australian Securities and Investments Commission (the ASIC Subpoena) be replaced with the amended Schedule 1 attached as Annexure A to these orders.

2. The ASIC Subpoena be stood over until 9:30am on 26 March 2014.

3. The Subpoenas issued by the Applicants to Maurice Noone and Colin McCloy of PriceWaterhouseCoopers, in their capacities as Receivers for the New Zealand entity OPI Pacific Finance Limited (in Receivership & Liquidation) be stood over until 9:30am on 19 March 2014.

Schedule 1

The documents and things you must produce are as follows:

1. The rationalised chronological index filed by ASIC in the Supreme Court of Queensland Proceeding No. 12122 of 2009 (the ASIC Proceeding), and the documents listed in that index (except for any transcript of examination already produced by ASIC in answer to the Subpoena to Produce documents addressed to ASIC which was issued at the request of the First and Second Respondents and filed in these proceedings on
30 October 2012).

2. All sworn affidavits and unsworn outlines of evidence filed or served by ASIC in the ASIC Proceeding in their original form and on which ASIC seeks to rely at the trial of the ASIC Proceeding commencing 4 November 2013 and any annexures or exhibits to those documents.

3. The written opening filed by ASIC in the ASIC Proceeding and all documents referred to in the written opening not already produced in accordance with paragraphs 1 and 2 above.
