Unless the govt gives its approval. Imho their is tacit approval by govt. Both FAR and the govt know WPL is spending money and within JV rules. Whilst I am a FAR holder, I cannot see the PE get up on the basis that they have not invoked arbitration or pushed the govt for a decision.
To my mind FAR want something from WPL or COP, what that is I am clueless. I would hate to see FAR go to arbitration after all this time. I think the big question will be, why didn't you come to us earlier. Or better still why didn't you seek injunction on JV proceeding until dispute settled. The excuse that we did not want to annoy the SNE govt just ain't going to cut it in court.
The chairman of Far had to say something in the annual report. In many respects he sounded a bit like PC did at the beginning of the saga. All imho.
