Guilty of what? There needs to be something specific they are being accused of, which comes back to the legal process as per the article.

There would be no presumption of innocence if they have been convicted and gaoled.

If the courts have ruled they are guilty, then the presumption of innocence is no longer required, as per article 14(2).

If they are wrongly convicted, then that is a different issue.

They can refer to her however they want, it is called an opinion.
