I'm not up to date with the latest Privacy Act amendment of 2012/13; but the 1988 Act allows transfer of data overseas as long as the recipient are subject to same data privacy principles or security setting as Australia.
I think this is more of a political move by Workcover NSW / VIC : If you want to be a re-seller of workers comp for the local government, you have to employ local people.
