Don't know if they can, I hope they do for those who hold? But I decided to exit today and cash out after holding a 50% paper loss for a long time, I decided to realise a 50% profit.
My biggest concern is the options that are available at 0.4c. 8,000,000 converted yesterday for a cost of $32,000, that if were dumped on the market tomorrow could net around $195,000. Nice profit for someone but it will drive the price down a lot and if I read the Appendix 3B correctly there are another 365,000,000 to go.
I personnaly think it will probably still rise overall (with a few ups and downs on the way) until the litigation is resolved, but I decided the risk is not for me at the moment. May get back in later, but in the meantime all the best to those who hold.
