Just to clarify and for all your information, they have one Australian PROVISIONAL patent application relating to the oper8tor. A provisional application cannot be prosecuted into a granted patent. They will need to newly file a COMPLETE patent application and prosecute the complete application in order to HOPEFULLY obtain patent rights. Patent right will ONLY be granted if the application meets certain requirements including novelty and inventiveness. At this stage, I understand that vonex has not even filed a complete patent application.
So to answer your question, at this stage, they have ZERO enforceble patent rights in relation to the oper8tor app.
What should be more of a concern now is whether they have any patents / patent applications covering their existing technology such as the technology for making it easy to set up communication networks. From what i can see, they have none (please let me know if im wrong with supporting evidence, because they could have filed it under a different name but i only search vonex) which is a real concern because this means that their current business is not protected and anyone can copy their technology and vonex wouldnt be able to do a thing about it. I encourage you all to find out from them whether their current technology (not the oper8tor app) is protected. So based on my understanding, they also have zero enforceable patent rights in relation their current technology which they are already exploiting - if true this is a real concern.
