proxy holders..warning

CityView Corporation Limited has, pursuant to a requisition of 5% or more of its shareholders, called a general meeting of shareholders at 11 am (wst) on Friday, 30 January 2009 (General Meeting).
Proxy forms will be reviewed prior to the General Meeting to ensure that they are valid.
CityView has obtained legal advice in relation to proxy forms returned to it by parties other than shareholders.
Proxy forms returned by a third party who is under no fiduciary duty or other obligation to the shareholder to safeguard and deliver the proxy forms will be invalid.
This approach will prevent any third party from filtering or inappropriately handling proxy forms so as to preserve the integrity of the voting process and is consistent with recent case law: Portman Iron Ore Ltd (2008) FCA 1362.
Shareholders are recommended to return their proxies directly to the Company in accordance with the directions given on the proxy form.
Shareholders should seek independent professional advice if they have any doubt as to completion of the proxy form.
