    Quebec, may 5, 2011- The tightening of the rules applicable to the shale gas industry will be in a period of pre-publication for a period of 30 days, after which two regulations will come into force, thus giving the recommendation formulated by the Bureau d'audiences publiques sur l'environnement (BAPE). The adoption of these transitional measures will enable the work of the strategic environmental assessment (sea) to begin in the coming weeks.


    Regulation on the application of the law on the quality of the environment

    The amendment to the regulation on the law on the quality of the environment aims to expand the liability of companies to obtain a certificate of approval for all drilling operations intended to search for or to exploit the oil or natural gas in shale as well as for any intended to search for or operate fracturing operation the oil and natural gas throughout the territory of Quebec.


    In addition, the amended regulation provides that the applicant for a certificate of approval is required to inform and consult the public. Thus, the issuance of any new certificate of approval shall be preceded by a consultation of the population. This consultation, which will be through local weekly newspapers and an Internet site, will be supported by the initiator of the project. The Minister of sustainable development, environment and parks may designate an observer or a moderator. Subsequently, a report will be produced and transmitted to the municipalities that will be invited to report their observations.


    Regulation on the transmission of information

    New regulations come into force, namely the regulation on the transmission of information related to the execution of some works of drilling and fracturing of gas or oil wells. This regulation aims, on the one hand, to obtain the commitment of the initiators to accede to the Protocol of the sea, and has set, on the other hand, the information that the holders of a certificate of approval will be required to provide periodically the MDDEP.


    Transmission of this information will enable, among other things, the acquisition of scientific and technical knowledge both on the geological, hydrological plans that geophysical, targeted work and their possible effects on human health or the environment. This enhanced framework will also allow the MDDEP to facilitate access to field data to feed the sea.


    These information are:

    *methods and technologies of drilling and completion of wells;
    *management full of water, including water withdrawals and optimal reuse of water;
    *the volume of fluids, detailed composition and characteristics of the inputs used in the drilling and fracturing;
    *knowledge and monitoring of surface and ground waters within a perimeter of a kilometre of the drilling or fracturing work, this perimeter applying to any extension horizontal drilling;
    *the determination of hotspots or at risk of contamination;
    *geochemistry and contamination by sewage of fracturing formations and the injection of wastewater in depth;
    *characterization, the quantity and the destination of the solids and residual liquids to be valued, treated or eliminated;
    *control and monitoring of contaminants in the atmosphere;
    *knowledge of the geological horizons crossed by the well;
    *any technical data relating to the design, the implementation of the authorized wells and the results of the integrity tests that are applied to them.
