I looked up 'hedging shares' and found a US court case

dealing with SEC ,a fund, beneficial ownership, inacurate disclosure, counterpartys, contractual provisions,and some of those "other financial instruments" used in the US.

So there seems to be legal and journalistic examination on the subject but unfortunatley I am not qualified to even partly understand/judge our situation.

From a laymans perspective there certainly seems to be some blank spaces that need disclosure which is why I am still searching and trying to follow this.
