Were Bolton's proposed wind up of brisconnections to succeed, presumably all assets of the company would be quickly depleted via breach of contract litigation. If this were the case would the underwriters then have to cough up several hundred million dollars for nix return?

Bolton's action just sounds better and better, assuming the guy has a viable escape. Else he is behaving like a suicide bomber.
