    "7. On 8 October 2015, IFFCO and Kisan applied to this Court for orders to enforce the Singapore award. The application was heard on 19 November 2015. On the same day, Queensland Phosphate Pty Limited (‘QPL’) was incorporated in Australia. The directors were Mordechai Gutnick (Gutnick’s son), Pnina Feldman (Gutnick’s sister),and Sholom Feldman (Pnina Feldman’s son).

    39. The directors of Legend are Joseph Gutnick, Henry Herzog and Mordechai Gutnick. Subject to the acceptance of resignations and processing, Sholomon Feldman and Pnina Feldman may also be directors of Legend. Each of Sholomon Feldman and Pnina Feldman provided letters of resignation, effective immediately, respectively on 20 and 21April 2016.

    40. The current directors of Paradise are Joseph Gutnick, Sholomon Feldman and Pnina Feldman."

    2. The respondents were appointedliquidators of Legend International Holdings Inc (in liq) (‘Legend’)by order of RandallAsJ on 2 June 2016. Legend owns 100 per centof the shares in the second applicant, Paradise Phosphate Ltd(‘Paradise’). Paradise owns various phosphate tenements inQueensland. The current directors of Paradise are Mr Sholom Feldman and hismother,Mrs Pnina Feldman. Mr Feldman and Mrs Feldman are, respectively, thenephew and sister of Mr Joseph Gutnick.

    15. On 24 April 2017, an applicationmade by the applicants (filed 12 April 2017) to vary the undertakings previouslygiven by theFeldmans was heard by Randall AsJ. The variation sought wasto enable the Feldmans, as directors of Paradise, to obtain a securedloan of $1million from Queensland Bauxite Ltd (another company associated with them) forthe purpose of funding legal and otherexpenses of Paradise. The applicationwas refused."
