In court you must prove intention, just because something didn't work out the way it was planned doesn't mean there was an intention to deceive.

The only people who have been successfully prosecuted have been shown to profit (or have associates that profited) from the SP movement.

If releasing information that caused shares to go up or down and was shown later to be incorrect was a criminal offence, then every politician (and maybe a reserve bank governor or two) would be in Jail.
