quit date - clarification of announcement

I emailed FMS directly about the quit date announcement and this is the response i received back. I am sure they will not mind me circulating this response on HC for shareholders...


" The Scheme quit date is 30 June 2012. The purpose of today’s announcement was to clarify that the end date is 30 June 2012, not 21 July 2012. Since Monday’s announcement, MMK and Flinders discussions have resulted in a mutually agreed quit date under the Scheme Implementation Agreement of 30 June 2012.


The quit date can be amended by mutual agreement by both MMK and FMS.

As per page 54 of the Scheme Booklet, the quit date relates to the Scheme lapsing if the Scheme does not become effective on or before the quit date (30 June 2012). The Scheme would become effective when the Court order is lodged with ASIC and the Scheme becomes binding.


There is no termination date as such, this is the quit date. Termination of the Scheme is discussed on 51 of the Scheme Booklet.
