1. That Anvil had knowledge that the killing was going to occur.
2. Anvil had a choice, they could have not provided the vehicles and plane to the govt.
If the transport was refused, what would have been the ramifications if those killed were the Anvil employees still on site and the villagers threatened by the rebels. Don't forget the villagers fled the rebels not the army.
Anvil also provided a lot of food and support once the situation stabilized.
If Anvil is convicted then the ramifications are huge. If say Qantas planes are used by the Australian govt to transport troops to say PNG and there is a shooting, is Qantas also guilty.
It is a hard one for any court to prove.
