There is not a bad read on this in the Financial Review page 4.
Basicly it says that Rio was given the opportunity to submit a limited range of evidence late last year to support BHP (as they had done earlier)but seemed to stop since BHP have put in a bid to take them over.
The case has been been judged and is to go to the Competition Tribunal to get sorted out
