There is a letter to the editor of the Australian today concerning breaches of the law which enabled Ramsay to takeover Alpha by paying 40 cents for shares with an assets backing of 82 cents.
The Commonwealth Ombudssman has become involved and is investigating ASIC's administration of many complaints made about the takeover.
Does anyone know of other cases where a bidder has been allowed to proceed with a takeover when breaches of the law have given the bidder premature control?
