    Could not agree more. And I think there is precedent in the High Court to support that unambiguous statement.
    What I am not sure of is the process should BTU win the other appeal - is that too likely to go the the HC of NZ? Is there a similar system as here, in that the vanquished has to seek leave to appeal to the HC?
    In any event, let's hope the shorting has finished.
