The two are mutually exclusive events. The Minister can’t accept the wardens recommendation as well as impose a penalty. If he accepted the recommendation to not grant exemption then the next step is the process of forfeiture, which in itself is the ultimate penalty.
If he rejects the wardens recommendation, grants exemption and imposed a penalty, that is acknowledgement that there was a breach, but not one serious enough to warrant forfeiture.
