You just need to apply a little logic to see that to fend off litigation it has to be reasonable. Like S&G indicated in the press, the deal will live or die by the price, very simple. So let just assume that the banks and their lawyers have half a brain and make an deal that will live with the price. Everyone knows roughly where the price is which is why medaition at FH level was possible in the first place.
