You still havent explained how MMX went from been broke in June 2004 to gaving 400k in the bank in september 2004 and made 600k in payments on the assets.
Your previous explanations can only be true if both old and new management of MMX lodged false documents about timing of capital raisings with ASX and ASIC.
Not a good defence saying your honour we lied in our reporting but now heres the real truth !!
Now that one will be laughed out of court !!!
