Oh yes that is just one of the legal avenues for defence, muddy the water so that no one can really be sure of what happened. There are lots of others.
Create a straw man for all to attack until it falls apart.
Create a common enemy, such as the ROGUE TRADER enemy that banks like to create.
Sacrifice a couple of plebs as in the above.
Discredit the witnesses.
Stack the jury.

When its all said and done the people that run the organisation are responsible for the culture of that organsation
