additional take home regarding the environmental issues is that testing is on-going and due to onset of winter (snows) will be ongoing till at least April. On the plus side it seems that Colorado State and Federal EPA have a fund to cover cleanups in this situation and have been cleaning up and will continue to clean up as required post winter.

However, i personally would not have considered entering into any agreement until site was given clean bill of health.
