remove the uncertainty

Given the uncertainty created by the recent court decision, I believe CSR has no choice but to keep all its options open at present. However, the company must eliminate this uncertainty by expeditiously seeking a legal pronouncement in an appellate court, so as to determine the best way forward.

Apart from testing the legitimacy of the demerger, the company must also get superior judicial clarification as to what restrictions (if any) will be placed on its future ability to conduct operations, especially in relation to acquiring and disposing of assets as well as in the use and application of funds. A non-restrictive legal ruling here should greatly improve its bargaining position in the current market for negotiating a trade sale to Brights or any other interested parties.
