If we think that ESI is going to mine and export coal from the LaTrobe valley then the mine plan has to conform with state and federal legislation.
The last variation to the Yallourn mine plan was the Maryvale field.
Critically, this was approved prior to the cut off (don't quote me on this but it was about) 21 July 2000 after which the Environment Protection and Biodiversity Conservation Act 1999 was changed to require assesment of impacts of carbon emissions of a mine.
The Hazelwood extension as assesed after this date, and the ESS was very nearly defeated, along carbon emission lines. IPA Haz had to agree to a 20 something % reduction in emissions over the life of the station.

LYang hasn't required a change in years.
Question. Are ESI going to use the previously sanctioned mine plans - and therefore reduce the amnount of pre-July 2000 coal available to the power station, or are they going to use a new mine.
And therefore go through the EPBCA process?
