Whenever there is a lien over a property selling the property does not normally extinguish that right.
It really depends on the original contract, lease or lien. For example you sell a house, car or other item that has a lien you do have to get the person holding that lien to extinguish it or you don't have clear title.
Now this becomes more complicated by AKW agreeing to transfer clear title. So who is responsible? It would firstly be up to the court to decide who the respondent is GGP or AKW?
The aggrieved party could go GGP in the first instance and then AKW later or they could drag them into court together as Co respondents in which case a Judge would decide whom is responsible and it could end up as a percentage from each.
Being that the US is extremely litigious, they sue each other for anything, this could go either way. AKW is currently suspended again from ASX, so your guess is as good as mine.
